1. Acceptance of Terms

By accessing or using ConstantSense AI API services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

ConstantSense AI provides advanced AI model inference API services using proprietary φ-spectral analysis technology. The Service allows developers to integrate AI capabilities into their applications through RESTful API endpoints.

3. API Usage

3.1 API Access

• You must register for an account and obtain API credentials to access the Service
• You are responsible for maintaining the confidentiality of your API keys
• You must not share your API credentials with third parties

3.2 Rate Limits

• Free Tier: 10 requests per minute, 10K tokens per month
• Basic Tier: 60 requests per minute, 100K tokens per month
• Premium Tier: 300 requests per minute, 1M tokens per month
• Enterprise: Custom rate limits

3.3 Prohibited Uses

You may not use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Distribute malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Use the Service for competitive analysis or benchmarking without permission
• Resell or redistribute the Service without authorization

4. Billing and Payment

4.1 Subscription Plans

Subscription fees are billed monthly in advance. Usage-based charges are billed at the end of each billing period.

4.2 Payment Terms

• All fees are in USD
• Payment is processed through Stripe
• Fees are non-refundable except as required by law
• We reserve the right to change pricing with 30 days notice

4.3 Overages

Usage exceeding your plan limits will be charged at standard overage rates: $0.01 per 1,000 tokens for Basic, $0.008 per 1,000 tokens for Premium.

5. Data and Privacy

5.1 Your Data

• You retain all rights to data you submit to the Service
• We process data solely to provide the Service
• We do not train our models on your data without permission
• Data is encrypted in transit and at rest

5.2 Data Retention

API request logs are retained for 30 days for operational purposes. You may request deletion of your data at any time.

6. Intellectual Property

6.1 Our IP

The Service, including all algorithms, models, and technology, is proprietary and protected by intellectual property laws. The φ-spectral analysis technology is proprietary to ConstantSense AI.

6.2 License

We grant you a limited, non-exclusive, non-transferable license to use the Service according to these Terms.

7. Service Availability

7.1 Uptime

We strive for 99.9% uptime but do not guarantee uninterrupted service. Enterprise plans include SLA guarantees.

7.2 Maintenance

We may perform scheduled maintenance with advance notice. Emergency maintenance may occur without notice.

8. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

9. Limitation of Liability

IN NO EVENT SHALL CONSTANTSENSE AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, OR USE.

10. Termination

10.1 By You

You may terminate your account at any time through your account settings or by contacting support.

10.2 By Us

We may suspend or terminate your access if you violate these Terms or for non-payment.

11. Changes to Terms

We may modify these Terms at any time. Changes will be effective upon posting. Continued use of the Service constitutes acceptance of modified Terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the appropriate courts.
